Learned counsel for the petitioner has filed this transfer application seeking transfer of M.C.No.132/2025, filed by the husband for divorce before the Principal Judge, Family Court, Bagalkot to the VI Additional Judge, Family Court, Bangalore. It is submitted that the petitioner is residing in Bangalore along with her parents and two minor children. The marriage between the petitioner and - 3 - HC-KAR NC: 2026:KHC:27771 CP No. 421 of 2025 the respondent was solemnized in the year 2010, and they are blessed with two children. It is further stated that the respondent had earlier filed M.C.No.4031/2022 for restitution of conjugal rights, which came to be disposed of on 29.02.2024 based on the consent of the parties. 3. Learned counsel for the petitioner submitted that, after the disposal of the RCR proceedings, both parties resided together for sometime. h bvSubsequently, the respondent left the matrimonial home and filed the present petition for divorce. It is further submitted that the petitioner has filed Crl.Misc.No.338/2022 seeking maintenance for herself and the children before the VI Additional Judge, Family Court, Bengaluru. The Court has granted interim maintenance of Rs.30,000/- per month to the children from the date of the application, but the respondent has failed to comply with the said order and has not paid the maintenance amount. 4. It is submitted that Execution Case No.293/2024 was filed in M.C.No.4031/2022. Thereafter, - 4 - HC-KAR NC: 2026:KHC:27771 CP No. 421 of 2025 the parties resided together, and the petitioner continued to reside in the same house. It is further submitted that both parties are joint owners of the said property. The children are aged 14 and 9 years respectively. The petitioner contends that the Family Court at Bagalkot has only temporary jurisdiction, as the respondent's parents reside there and he frequently visits the place. The distance between Bengaluru and Bagalkot is approximately 474 kilometres, and therefore the petitioner seeks transfer of the case. 5. Learned counsel for the respondent reports no objection to the transfer of the case and requests this Court to direct the Family Court to dispose of the matter at the earliest. 6. Considering the distance between the two places and the inconvenience that would be caused to the petitioner in travelling with two minor children, this Court finds it reasonable to transfer M.C.No.132/2025, filed by the respondent-husband for divorce before the Principal - 5 - HC-KAR NC: 2026:KHC:27771 CP No. 421 of 2025 Judge, Family Court, Bagalkot, to the VI Additional Judge, Family Court, Bengaluru, where Crl.Misc.No.338/2022 is already pending between the parties. 7.
