Father of petitioner no. 2 was employed as Sweeper in Nagar Palika Parishad, Muni Ki Reti in District Tehri Garhwal, who died while in service on 28.8.2025. Petitioner no. 1, who is daughter-in-law of the deceased and wife of petitioner no. 2, applied for compassionate appointment. Her claim, however, was rejected vide order dated 22.12.2025. 3. Learned Counsel for the petitioners submits that petitioner no. 2 has also applied for compassionate appointment and his request is pending consideration before the competent authority. He submits that even though father of petitioner no. 2 was engaged on daily wages, but he served continuously for more than 14 years, therefore the deceased cannot be treated as a casual employee and petitioner no. 2 is, therefore, entitled to be given regular appointment. He submits that petitioner no. 2 is even ready to serve as a daily wager, if he is offered engagement in that capacity. 4. Mr. Sandeep Kothari, learned Counsel appearing for Nagar Palika Parishad, submits that claim staked by petitioner no. 2 shall be considered by the competent authority and if work is 2026:UHC:2339 available, then he can be engaged as a daily wager. 5. Writ petition is, accordingly, disposed of by directing the Executive Officer, Nagar Palika Parishad, Muni Ki Reti to take decision on petitioner’s representation, sympathetically, within six weeks from the date of presentation of certified copy of this order.
