The present writ petition has been filed for the following reliefs:- “(i) for issuance of an application appropriate writ(s), order(s) or direction(s) particularly a writ in the nature of certiorari for quashing of reasoned order passed vide Reference No. BCCL/D(HR)/2025/F-05/45 (A-7) dated 10.06.2025 issued by the Director (HR) B.C.C.L by which the claim of C.M.P.F. and pension were settled in favour of Respondent No.5. (ii) for issuance of an appropriate writ(s), order(s), direction(s) particularly a writ in the nature of mandamus commanding to upon the respondents to grant the retiral benefits of Late Ashok Kumar Sahay to this petitioner who is the only surviving daughter of Late Ashok Kumar Sahay. Earlier, the petitioner has approached this Court by filing writ petition being W.P.(S) No.5949 of 2022, which was disposed of, vide order dated 24.10.2024, whereby liberty was given to the petitioner to approach before the respondent No.2 i.e., Director of Personnel Department, (Pension & P.F) and the respondent No.2 was directed to consider the case of the petitioner in accordance with law. 4. Admittedly, it is a dispute of status between the petitioner and the respondent No.5 and it can only be resolved by a competent Civil Court or Family Court. 5. In that view of the matter, learned counsel for the petitioner seeks permission to withdraw the present writ petition with a liberty to work out her remedy in accordance with law. 6. Learned counsel for the other side has raised no objection. 7. Permission is granted. Accordingly, the present writ petition is hereby, disposed of as withdrawn with the aforesaid liberty.
