The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.02.05 16:55:18 +0530 2 with Crime No.1456/2025, registered at Police Station Civil line, Bilaspur (C.G.) for alleged commission of offence punishable under Sections 118(1), 296, 3(5) & 351(2) of Bharatiya Nyaya Sanhita ("BNS") 2. Case of the prosecution, in brief, is that the incident occurred on 08 December 2025 at about 8:30 PM complainant/injured was travelling in his car along with his friend Nitya Dubey, from Shanti Nagar towards Koni. When they reached near Chadda Badi, Nehru Nagar, they were intercepted by the co-accused Kanha Upadhyay and Nimit Dubey and they objected to Nitya Dubey travelling with the complainant and began abusing him using filthy and obscene language, accompanied by threats. Co-accused called the present applicant over the phone thereafter applicant came on the spot and attempted to run over the complainant with the motorcycle, and when the complainant resisted and the motorcycle fell on the road, the applicant allegedly took out a sharp-edged knife and assaulted the complainant. It is further alleged that the co-accused persons assaulted the complainant with stones and collectively threatened to kill him, forcing him to flee towards a nearby medical store to save his life. Therefore, FIR bearing Crime No. 1456/2025 was registered for offences under Sections 118(1), 296, 3(5) and 351(2) of the Bharatiya Nyaya Sanhita, 2023. 3. Learned counsel for the applicant submits that the applicant has no role in the alleged incident and has been falsely implicated due 3 to exaggeration of facts by the complainant. The applicant reached the spot only after receiving a phone call from the brother of Nitya Dubey and merely attempted to intervene after an altercation had already taken place between the complainant and the co-accused persons. It is further submitted that the applicant neither used any dangerous weapon nor caused any grievous injury to the complainant. He would submit that the applicant is a 20-year-old engineering student and he is ready to abide by all the directions and conditions which may be imposed by this Court while granting bail, the applicant is permanent resident of above mentioned address shown in the cause title and there is no likelihood of his absconding or tampering with prosecution witnesses, therefore he prays to enlarge the applicant on anticipatory bail. 4. On the other hand, learned State counsel as well as learned counsel for the complainant oppose the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, submission of learned counsel for the parties, materials available on record, further the fact that the applicant assaulted the complainant with a sharp-edged weapon, causing multiple injuries on vital parts of the body, considering the gravity of the offence, the manner of assault 4 and further considering the fact that investigation is still going on, therefore I am not inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the anticipatory bail application of the applicant - Rajveer Singh Babra, involved in Crime No.1456/2025, registered at Police Station Civil line, Bilaspur (C.G.) for alleged commission of offence punishable under Sections 118(1), 296, 3(5) & 351(2) of Bharatiya Nyaya Sanhita is rejected.
