W.P.(C) 13841/2026 $~2 * IN THE HIGH COURT OF DELHI AT NEW DELHI # CNR No. DLHC010450002026 + W.P.(C) 13841/2026 & CM APPLs. 64790-91/2026 M/S VIRAJ IMPEX PRIVATE LIMITED .....Petitioner Through: Mr. Shekhar Prit Jha, Ms. Preeti Kumari, Ms. Akansha Yadav, Ms. Shushmita Rawat, Advocates with Mr. Ashok Kumar. versus GOVERNMENT OF NCT OF DELHI & ORS. .....Respondents Through: Ms. Nitika Bhutani, Advocate for R1 to 3. Mr. Sameer Vashisht, SC GNCTD. Mr. V.P. Rana and Mr. Aviral Jain, Advocates for R4 and 5. CORAM: HON’BLE MR. JUSTICE PRATEEK JALAN O R D E R % 28.09.2026 1. By order dated 21.09.2026 passed in this petition, it was recorded as follows: “1. By way of this petition under Article 226 of the Constitution, the petitioner essentially seeks direction upon respondent – Authority to decide an appeal filed by it [Revenue Appeal No.7/4/2022], which is stated to have been pending for four years. 2. Ms. Nitika Bhutani, learned counsel, appeared on behalf of the Government of National Capital Territory of Delhi [“GNCTD”] on the first call, and the petition was passed over to enable her to take instructions with regard to the time period during which the appeal will be decided. 3. On the second call, Ms. Bhutani submits that she has only been able to get limited instructions that the appellate authority is not deciding any such appeal in view of the fact that the village in question has been urbanised. If it is the contention of the State that, due to urbanisation of the land, the appeal cannot be decided on merits, at least an order should be passed disposing of the appeal on that basis, so that the concerned party can take its remedies, if so advised. 5. Ms. Bhutani also states that there are related proceedings pending before the Division Bench of this Court. 6. Ms. Bhutani is requested to forward a copy of this order to Mr. Sameer Vashisht, learned Standing Counsel for GNCTD, who is requested to assist the Court on the next date of hearing. 7. Mr. Shekhar Prit Jha, learned counsel for the petitioner, states that there is a pending civil suit between the petitioner and the private respondents, which would be affected by the result of this petition. The petitioner is at liberty to take such proceedings as it is advised, in respect of the pending suit. No directions in that regard are required in this writ petition. 8. List on 28.09.2026.” 2. Mr. Sameer Vashisht, learned Standing Counsel for the Government of National Capital Territory of Delhi, submits that the appeal of the petitioner will be decided one way or the other within a period of four weeks from today. However, he submits that there are proceedings pending before the Full Bench of this Court, which may have a bearing upon the result of the appeal. If that is so, the respondents – Authorities may keep the appeal pending, and communicate the legal grounds for deferring the decision to the petitioner within the same period, so that the petitioner can take necessary steps. 3. As no further orders are sought in this writ petition, the writ petition is disposed in terms of the above. 4. Pending application also stand disposed of.
