[2026:RJ-JP:780] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 15187/2025 Juber @ Chepachi S/o Deenu, Aged About 29 Years, R/o Ranf, Police Station Kaithwada, District Deeg. (At Present Accused Petitioner Confined In Sub Jail Deeg). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent Connected With S.B. Criminal Miscellaneous Bail Application No. 16198/2025 1. Mubeen S/o Mehtab, Aged About 43 Years, R/o Mungaska, Police Station Pahari, District Deeg, Rajasthan. (At Present Confined In Sub Jail Deeg, Dist. Deeg). 2. Mustak S/o Mehtab, Aged About 35 Years, R/o Mungaska, Police Station Pahari, District Deeg, Rajasthan. (At Present Confined In Sub Jail Deeg, Dist. Deeg). ----Petitioners Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Ankit Khandelwal Mr. Khizer Iqbal Khan For Respondent(s) : Mr. Manvendra Singh Shekhawat, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 09/01/2026 1. The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.17/2025 registered at Police Station-Sikri, District-Deeg for the offences under Sections 5 and 8 of RBA Act and Section 109(1) of BNS. [2026:RJ-JP:780] (2 of 3) [CRLMB-15187/2025] 2. Since both the bail applications have arisen from common FIR, hence, they are being decided by this single order. 3. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. 4. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in these cases. He further submits that the petitioners were not present at the place of the incident. He argues that the present petitioner, Juber @ Chepachi, is merely the owner of the vehicle and, therefore, on that ground alone, his implication in the alleged offence is unsustainable. He further submits that the other accused-petitioners, namely Mubeen and Mustak, were also not present at the spot and that the FIR has, in fact, been lodged against unknown persons. The case is triable by Magistrate. Petitioners are behind the bars since 16.10.2025. Charge-sheet has been filed. The trial of the cases may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, hence, the bail applications of the petitioners may be allowed. 5. Learned Public Prosecutor has vehemently opposed the bail applications. 6. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. [2026:RJ-JP:780] (3 of 3) [CRLMB-15187/2025] 7. Accordingly, the bail applications under Section 483 B.N.S.S. are allowed and it is ordered that the petitioners-Juber @ Chepachi S/o Deenu, Mubeen S/o Mehtab and Mustak S/o Mehtab shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
