Accused in Crime No.15/2026 registered by N.R.Pura Police Station, Chickmagaluru District for the offence punishable under Section 108 of BNS, 2023 is before this Court in this criminal petition filed under Section 482 of BNSS, 2023 seeking for anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.15/2026 was registered by N.R.Pura Police Station, Chickmagaluru District for the aforesaid offences against the petitioner based on the first information dated 09.02.2026 received from one Ramesh Shetty - brother of deceased Sharada Shetty. Apprehending arrest in the case, petitioner had filed Crl.Misc.Petn.No.101/2026 before the jurisdictional Sessions Court, which was rejected on 07.03.2026. Therefore, he is before this Court. - 3 - HC-KAR NC: 2026:KHC:27864 CRL.P No. 4629 of 2026 4. Perusal of the averments found in the first information would reveal that the petitioner is the younger brother of Sridar Shetty who is the husband of deceased Sharada Shetty. It appears that Sridar Shetty and the petitioner had some civil dispute with regard to certain agricultural property. It also appears that in this background, there were several civil and criminal case filed between each other. In the first information, it is stated that the petitioner was troubling his brother and his sister-in-law because of the pending civil dispute and he also was criminally intimidating them. Sharada Shetty consumed pesticide at about 10.00 p.m. on 04.02.2026 and immediately thereafter she was shifted to a hospital but she had died in the said hospital on 08.02.2026 while undergoing treatment. 5. FIR was subsequently filed on 09.02.2026 by her brother. There is no mention of any incident that had taken place on 04.02.2026 in which the petitioner had participated, which would have instigated or abetted the deceased to commit suicide. Undisputedly, the petitioner has no other criminal antecedents and he has undertaken to cooperate with the police. - 4 - HC-KAR NC: 2026:KHC:27864 CRL.P No. 4629 of 2026 6. Under these circumstances, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following: ORDER The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.15/2026 registered by N.R. Pura police station for the offences punishable under Section 108 of BNS, 2023 subject to the following conditions: i. The petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (One lakh only) with two sureties for the likesum to the satisfaction of the investigating officer. ii. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. - 5 - HC-KAR NC: 2026:KHC:27864 CRL.P No. 4629 of 2026 iii. Petitioner shall not tamper with the prosecution witness and he shall co- operate with the police for investigation and appear before them whenever called upon. iv.
