This application is directed against the judgment dated 02.05.2026 passed by the learned Additional Sessions Judge I cum Children Court, Deoghar in Criminal (Juvenile Bail) Appeal No. 26 of 2026 whereby and whereunder the order dated 04.04.2026 passed by the learned Principal Magistrate, Juvenile Justice Board, Deoghar in Mohanpur P. S. Case No. 5 of 2026 rejecting the prayer for bail of the petitioner has been affirmed. It has been alleged that the son of the informant was taken away by the accused persons including the present petitioner for celebrating a new year party. Subsequently, the accused persons are said to have committed assault upon the son of the informant, who died during treatment Submission has been advanced by the learned counsel for the petitioner that the main allegation of assault has been attributed against Sushant Yadav and Satyam Kumar. It has further been submitted that the petitioner does not have any criminal antecedent and in fact one of the similarly situated co-accused namely, Mantu Kumar Yadav has been granted bail by this court in B. A. No. 4621 of 2026. It has also been submitted that the petitioner is in remand home since 10.01.2026. Learned A.P.P. for the State has opposed the prayer for bail. -2- Regard being had to the fact that Sushant Yadav and Satyam Kumar are the main persons who have committed assault upon the son of the informant and the fact that the petitioner does not have any criminal antecedent, while setting aside the judgment dated 02.05.2026 passed by the learned Additional Sessions Judge I cum Children Court, Deoghar in Criminal (Juvenile Bail) Appeal No. 26 of 2026 as well as the order dated 04.04.2026 passed by the learned Principal Magistrate, Juvenile Justice Board, Deoghar in Mohanpur P. S. Case No. 5 of 2026, direct that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of the learned Juvenile Justice Board, Deoghar in connection with Mohanpur P. S. Case No. 5 of 2026, subject to the condition that the mother of the petitioner shall take care of the petitioner and shall not allow the petitioner to mingle with anti-social elements.
