This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the Applicant, who is apprehending his arrest in connection with Crime No.153/2026 registered at Police Station –Sirgitti, District Bilaspur (C.G.) for the offence punishable under Sections 296, 115(2), 118(2), 351(3) and 3(5) of BNS as also under Sections 25 & 27 of Arms Act. Briefly stated, the prosecution case is that on 04.03.2026, during the Holi festival, the complainant namely Rajkumari Nirmalkar had come to her parental home situated at Nayapara, Kritinagar, Sirgitti. At about 4:30 PM, near Shiv Mandir, Vikas Kirana Store, Nayapara, the present Applicant and other co-accused persons allegedly used filthy language while talking, to which the complainant objected. Thereafter, the Applicant and other co-accused allegedly assaulted the complainant and her family members. Based on these allegations, the aforesaid offences have been registered against the present Applicant. Hence, this application.

Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is further submitted that the Applicant had only participated in the alleged incident and has not caused any injury to the injured persons. It is also submitted that the Applicant is a young student and the sole earning member of his family and conclusion of trial is likely to take quite some time for its conclusion, therefore, he may be granted anticipatory bail.
4. On the other hand, learned counsel for the State opposed the prayer for grant of anticipatory bail and submitted that out of the three injured persons, two sustained simple injuries, while
3 one suffered a grievous injury to his abdomen, therefore, the Applicant does not deserve to be granted anticipatory bail.

Considering the submissions advanced by learned Counsel for the parties, the facts and circumstances of the case, further considering the nature and gravity of the offence as out of three injured persons, one has suffered a grievous injury to his abdomen also also considering that investigation is still going on, without further commenting anything on the merits of the case, this Court is not inclined to grant anticipatory bail to the Applicant.

Accordingly, the Anticipatory Bail application of the Applicant – Ghuru Kori filed under Section 482 of the BNSS, 2023 in connection with Crime No.153/2026 registered at Police Station –Sirgitti, District Bilaspur (C.G.) for the offence punishable under Sections 296, 115(2), 118(2), 351(3) and 3(5) of BNS as also under Sections 25 & 27 of Arms Act, is hereby rejected.
7. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information.
