M SREENIVASA REDDY, S/O.MAMILAPALLY SARABHA REDDY AGED 54 YEARS OCC BUSINESS D.NO.4-218/1, MOHAN RAO COLONY BALAJI NAGAR, JAWAHAR NAGAR MEDCHAL- LVLALKAJGIRI DISTRICT - 500 087. 2 Dr. YLR, J W.P.No.11534 of 2026 Dated 05.05.2026 ...RESPONDENT(S): Counsel for the Petitioner: K B RAMANNA DORA Counsel for the Respondent(S): GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue a Writ order or a direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents more particularly 4TH respondent in interfering with civil disputes and extending threats to the Petitioner in respect of agricultural land admeasuring Ac 1.67 cents in Survey Nos.805/4, Ac. 2.87 cents in Survey No. 805/1, Ac. 1 67 cents in Survey no. 805/2, Ac. 2. 96 cents in Survey No. 805/3, Ac. 4 98 cents in Survey No. 695/2, Ac. 2. 57 cents in Survey No. 804/2, Ac. 5 75 cents in Survey No. 696/2, and AC. 2.72 cents in Survey No.804/3 at Komarole Village Pullalacheruvu Mandal Prakasam District and threatening to settle the disputes with 5TH and 6TH respondents without issuing any notice or furnishing information and following due process of law as illegal unwarranted unsustainable arbitrary unconstitutional against Law as well principles of natural justice and consequently direct the Respondents not to interference with the Petitioner without following due process of law and pass….” 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader. 3. Mr. K.B. Ramanna Dora, learned counsel for the petitioner, submits that the 4th respondent is interfering in the civil disputes and extending threats to the petitioner in respect of the agricultural lands admeasuring Ac.1.67 cents in Survey No.805/4, Ac.2.87 cents in Survey No.805/1, Ac.1.67 cents in Survey 3 Dr. YLR, J W.P.No.11534 of 2026 Dated 05.05.2026 No.805/2, Ac.2.96 cents in Survey No.805/3, Ac.4.98 cents in Survey No.695/2, Ac.2.57 cents in Survey No.804/2, Ac.5.75 cents in Survey No.696/2, and Ac.2.72 cents in Survey No.804/3, situated at Komarole Village, Pullalacheruvu Mandal, Prakasam District, and is threatening the petitioner to settle the disputes with respondent Nos.5 and 6 without issuing any notice, furnishing information, or following due process of law. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, submits that the 6th respondent lodged a complaint before the respondent police alleging that he had entered into an agreement with the petitioner for purchase of the subject land for a consideration of Rs.44,33,440/- and paid an advance amount of Rs.10,00,000/- to the petitioner. It is further submitted that, when the 6th respondent requested the petitioner to execute the registration of the land, the petitioner allegedly refused to register the property and threatened the 6th respondent with dire consequences. Based on the said complaint, the 6th respondent requested the respondent police to take necessary action against the petitioner. The learned Assistant Government Pleader further submits that, upon receipt of the complaint, the respondent police called the petitioner only for the purpose of enquiry. It is submitted that the respondent police acted strictly in accordance with law on the basis of the complaint lodged by the 6th respondent. 5. Having regard to the entire facts and circumstances of the case, and recording the submissions made by the learned Assistant Government 4 Dr. YLR, J W.P.No.11534 of 2026 Dated 05.05.2026 Pleader, this Writ Petition is disposed of directing the respondent police not to interfere henceforth in the civil disputes pending between the petitioner and the unofficial respondents, without following due process of law. 6. In the result, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
