Accused in SC No.528/2026 pending before the Court of LIII Additional City Civil and Sessions Judge, Bengaluru, arising out of Crime No.30/2026 registered by Adugodi Police Station, Bengaluru, for the offences punishable under Sections 69 and 318(4) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in the present case was registered for the aforesaid offences by Adugodi Police Station, Bengaluru, against the petitioner herein based on the first information dated 23.01.2026, received from the alleged victim, who was aged 30 years. During the course of investigation, petitioner was arrested on 23.01.2026 and remanded to judicial custody. His bail application filed before the Trial Court was rejected. Therefore, he is before this Court. 4. Learned counsel for the petitioner having reiterated the grounds urged in the petition submits that petitioner and the - 3 - HC-KAR NC: 2026:KHC:27696 CRL.P No. 7153 of 2026 victim lady were in consensual relationship for a considerable period of time. Only after the same had failed, she had submitted a false complaint. He submits that in Crl.P.No.2733/2026, further proceedings in Crime No.30/2026 is stayed by the Co-ordinate Bench of this Court. In spite of the same, charge sheet was filed against the petitioner. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP, who has opposed the petition however does not dispute the submission made by learned counsel for the petitioner. 6. A reading of the first information as well as the charge sheet allegations would reveal that petitioner was pursuing his PhD in NIMHANS Medical College and the alleged victim was working as a contract staff in the said college. Petitioner and the victim had developed intimacy with each other and they also had sexual intercourse and as a result, victim girl allegedly had conceived. Subsequently, the victim girl had got the said pregnancy terminated. Victim has alleged that though she had not completely recovered thereafter, petitioner tried to have sexual intercourse with her. Petitioner thereafter allegedly also - 4 - HC-KAR NC: 2026:KHC:27696 CRL.P No. 7153 of 2026 developed friendship with CW2 and also had sexual relationship with her and thereafter, cheated CW1 and CW2. 7. A reading of the first information as well as the charge sheet material would go to show that first informant and the petitioner were in a consensual relationship for a considerable period of time and only after the same had failed, the first informant had approached the police and FIR was registered against the petitioner in the present case. It appears that under the said circumstances, further proceedings in Crime No.30/2026 has been stayed by the Co-ordinate Bench of this Court in Crl.P.No.2733/2026 and the said stay is in operation as on this date. 8. Petitioner, who has no other criminal antecedents and who is said to be pursuing his PhD course, is in custody in the present case from 23.01.2026. Though the Co-ordinate Bench of this Court has granted interim bail to the petitioner on 21.05.2026, since the petitioner could not comply the condition imposed by providing two local sureties, he has remained in jail till date. Under the circumstances, I am of the opinion that his - 5 - HC-KAR NC: 2026:KHC:27696 CRL.P No. 7153 of 2026 prayer for grant of regular bail needs to be answered affirmatively. Accordingly, the following:- 9. The petition is allowed. The petitioner is directed to be enlarged on bail in SC No.528/2026 pending before the Court of LIII Additional City Civil and Sessions Judge, Bengaluru, arising out of Crime No.30/2026 registered by Adugodi Police Station, Bengaluru, for the offences punishable under Sections 69 and 318(4) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 6 - HC-KAR NC: 2026:KHC:27696 CRL.P No. 7153 of 2026 10. In view of the disposal of the main petition, pending interlocutory applications, if any, do not survive for consideration. Hence, disposed off.
