02/15.07.2026 Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending her arrest in connection with Katras P.S. Case No. 56 of 2026, registered for the offence under Sections 341(1), 303(2) and 62 of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Sub Divisional Judicial Magistrate, Dhanbad.

Learned counsel appearing for the petitioner submits that the petitioner happens to be housewife however, husband of this petitioner has taken the motorcycle in her name and the said motorcycle is being used by her husband namely Gulzar and the said motorcycle was found parked near the place where the attempt of theft was made. He next submits that husband of the petitioner namely Gulzar has already been apprehended. He also submits that the petitioner is having no criminal antecedent as disclosed in para 13 of the petition.

Learned counsel appearing for the State opposes the prayer and submits that the husband of the petitioner has already been apprehended.

Considering that only the motorcycle is in the name of the petitioner and the petitioner is having no criminal antecedent as disclosed in para 13 of the petition and the said motorcycle is being used by her husband namely Gulzar and he has already been apprehended, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner.
6. Accordingly, the above-named petitioner is directed to surrender before the learned court within two weeks from today and in the event of
2026:JHHC:20926 her arrest or surrender, she shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Dhanbad, in connection with Katras P.S. Case No. 56 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
