ORAL ORDER Sri.Hareesh Bhandary T., counsel for the petitioner and Sri.L.Shekar, counsel for the respondent appeared in person. 2. This petition is filed seeking following reliefs: (a) Issue a Writ, Writ in the nature of certiorari in setting aside the Award dated 19.06.2025 passed by the Principal District and Sessions Judge, Hassan in I.I.D.No.2/2016 vide Annexure "A" (b) Issue a writ, writ in nature of direction directing the Principal District and Sessions Judge, Hassan in I.I.D.No.2/2016 to hold the Enquiry on the merits of the case by extending the opportunity to the parties. (c) Grant such other relief or relief's as this Hon'ble Court deems fit under the fact and circumstance of the case. 3. Sri.L.Shekar, counsel for the respondent submits that a memo has been filed on 08.06.2026 stating that the order passed by the Court on 19.06.2025 is recalled and the case is posted for further evidence on other issues. therefore, submits that the same may be placed on record and suitable order may be passed. 4. Sri.Hareesh Bhandary T., counsel for the petitioner submits that though the Court had passed the order on 19.06.2025, remitting the matter to the disciplinary authority, however, the same has been recalled. Hence, the prayer sought in the writ petition may not survive for consideration as of today. 5. The submission made by the respective parties is placed on record. 6.
Heard the arguments of the respective parties and perused the papers with utmost care. 7. Suffice it to note that the Court vide order dated 19.06.2025 passed the order holding that the departmental enquiry conducted by the Corporation was not fair and proper and the same was set aside and the matter was sent back to the Corporation for fresh consideration. However, after filing an application by the workmen in I.A.No.2, the same has been allowed and the order dated 19.06.2025 has been recalled. - 4 -

Hence, the prayer sought in the writ petition may not survive for consideration. 8. As the dispute is raised in 2016 and the same is pending for nearly ten years, hence, a gentle request is made to the Labor Court to dispose of the case within an outer limit of nine months from the receipt of certified copy of this order. The parties to the lis are directed to cooperate with the Labor Court to dispose of the case. 9. Accordingly, the writ petition is disposed of. SD/- (JYOTI M) JUDGE SS List No.: 1 Sl No.: 23
