04/13.07.2026 Heard Mr. Kamdeo Pandey, learned counsel for the appellants and learned Spl.P.P. for the State. This appeal is directed against the order dated 21.02.2026 passed by the learned Additional Sessions Judge-I, Giridih in M.C.A. No. 371 of 2026 and M.C.A. No. 466 of 2026 in connection with S.T. Case No. 48/2024 arising out of Madhuban P.S. Case No. 05 of 2017, whereby and whereunder, the prayer for regular bail of the appellants have been rejected. It has been alleged that a raid was conducted by the police and C.R.P.F. personnel in the Madhuban area to curb the activities of Naxals. One person, namely, Dipu Marandi, was apprehended, who had disclosed about the other accused persons. It has also been alleged that, on the confession of Dipu Marandi, several arms, ammunitions and bombs were recovered. Submission has been advanced by the learned counsel for the appellants that the appellants have been implicated on the confessional statement of Dipu Marandi. It has further been submitted that the appellants are in

custody since 29.09.2023. Learned counsel adds that some of the co-accused persons have already been granted bail in B.A. No. 9996 of 2019 and even Dipu Marandi has been granted bail in B.A. No. 8007 of 2017. Learned Spl. P.P. has opposed the prayer for bail of the appellants and, on going through the case diary, has submitted that the appellants have got one criminal antecedent. It has, however, been admitted that, based on the disclosure made by Dipu Marandi, the appellants have been implicated.
Regard being had to the manner of implication of the appellants and the fact that the co-accused, Dipu Marandi, who seems to be the main accused, has been granted bail, we, while setting aside the order dated 21.02.2026 passed by the learned Additional Sessions Judge-I, Giridih in M.C.A. No. 371 of 2026 and M.C.A. No. 466 of 2026, direct that the appellants be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each, to the satisfaction of the learned Additional Sessions Judge-I, Giridih, in connection with S.T. Case No. 48/2024 arising out of Madhuban P.S. Case No. 05 of 2017. This appeal stands allowed. (Rongon Mukhopadhyay, J.)
