Heard Mr. Pawar, learned Counsel appearing for the Applicant and Ms. Yadav, learned APP, for the Respondent-State of Maharashtra. 2. By this Anticipatory Bail Application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicant is seeking pre-arrest bail in connection with CR No.199 of 2026 registered with Malegaon Police Station, Pune Rural, for the offences punishable under Sections 109(1), 115(2), 126(2), 351(2), 351(3), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (“BNS”). 3. The prosecution case is set out in Paragraph No.3 of the Page 1 Arjun 919-ABA-2871-2026.DOC Anticipatory Bail Application, which reads as under: “3. It is alleged by the first informant that on 09/08/2026, at about 9:00 a.m., the complainant had gone to Malegaon Budruk for a haircut. After getting his haircut, at about 9:50 a.m., while the complainant was proceeding on his motorcycle from Malegaon Budruk towards Malegaon-Shirvali Road, near the Factory Road burial ground, the applicant along with two unknown persons, came on his motorcycle and deliberately dashed his motorcycle against the complainant's motorcycle, as a result of which the complainant fell to the ground. It is further alleged that applicant started assaulting the complainant with an iron rod and gave a blow on the right side of his ribs and said that, "Now we will not leave you alive. How dare you depose against us? Why are you getting so involved in village politics? Now we will see to you. It is further alleged that" Thereafter, applicant and the two persons accompanying him assaulted the complainant with fists and kicks, abused him and threatened him. It is further alleged that when they noticed people getting gathered, the accused persons fled from the spot. It is further alleged that the first informant became unconscious and fell to the ground at the spot. It is further alleged that after some time, his younger brother, Sachin Vasantrao Taware, arrived there and took him to Malegaon Police Station. The police issued a medical list, pursuant to which the complainant was taken to Punyashlok Ahilyadevi Holkar Medical Hospital, where he was admitted for treatment.” 4. The Applicant has assaulted the injured with an iron rod, gave a blow on the right side of his ribs and also threatened him. 5. There are 15 criminal antecedents against the Applicant and the provisions of the Maharashtra Control of Organised Crime Act, Page 2 Arjun 919-ABA-2871-2026.DOC 1999 have also been invoked. 6.
