No.2 vide order dated 22.04.2024 passed in A.B.A. No. 1509 of 2024. 2. Learned counsel for the petitioner submits that on the false submission the O.P. No.2 has obtained anticipatory bail. He further submits that money has not been returned however submission was made that money has been returned and in view of that the anticipatory bail granted to the O.P. No.2 may kindly be cancelled. 3. Learned counsel for the State submits that it was not only consideration, the Court has also found that the case was civil in nature and in view of that anticipatory bail was granted. 4. It transpires that matter is arising out of agreement of sale of the plot and in view of that prima facie the Court found that case is civil in nature and coming within the purview of Specific Performance Act and in view of that the anticipatory bail was granted to O.P. No.2. 5. In view of above no case of interference is made out as it is well known fact that once bail is granted only on cogent reason it can be cancelled.
