Accused in C.C.No.10822/2026 pending before the Court of XXXII Additional Chief Judicial Magistrate, Bengaluru, arising out of Crime No.386/2025 registered by Nandini Layout Police Station, Bengaluru, for the offences punishable under Sections 109, 115(2), 85, 351(3) and 352 of the Bharatiya Nyaya Sanhita, 2023, is before this Court under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail. 2. Heard the learned counsel for the petitioner and the learned HCGP for the respondent - State. 3. FIR in Crime No.386/2025 was registered by Nandini Layout Police Station for the aforesaid offences against the petitioner herein based on the first information dated 24.12.2025 received from his wife, Smt. Vidya Lakshmi. In the said case, the petitioner was arrested on 24.12.2025 and remanded to judicial custody. After completing investigation, - 3 - HC-KAR NC: 2026:KHC:27961 CRL.P No. 4833 of 2026 charge sheet has been filed against him for the aforesaid offences. The bail application filed before the Trial Court in Crl.Mis.No.2068/2026 was rejected on 05.03.2026. Therefore, he is before this Court. 4. A perusal of the material on record would go to show that the injured victim in the present case is the wife of the petitioner and from the wedlock, they have a son, aged about 5 years. The victim has alleged in her first information that the petitioner is addicted to vices and he was in the habit of quarreling with her. On 23.12.2025 at about 8:20 p.m., the petitioner allegedly came to the workplace of the victim and after quarreling with her, assaulted her with a knife which he had brought with him and caused grievous injuries. Immediately thereafter, she was shifted to Sanjeevini Multi Specialty Hospital at Mahalakshmi Layout and based on her statement recorded in the hospital, FIR was registered against the petitioner for the aforesaid offences. 5. The investigation in the case is completed and charge sheet has been filed. It is not in dispute that the petitioner has no criminal antecedents. The wound certificate of the injured - 4 - HC-KAR NC: 2026:KHC:27961 CRL.P No. 4833 of 2026 victim would go to show that she was treated as an in-patient in the hospital only for one day. She had suffered three injuries and out of the same, two are said to be grievous injuries. It is not in dispute that the injured victim has recovered and her condition is stable. It is trite that the accused cannot be detained in custody as a precautionary or preventive measure. Considering the relationship between the parties and also the nature of allegations made against the petitioner, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following:- 6. The petition is allowed. The petitioner is directed to be enlarged on bail in C.C.No.10822/2026 the Court of XXXII Additional Chief Judicial Magistrate, Bengaluru, arising out of Crime No.386/2025 registered by Nandini Layout Police Station, Bengaluru, for the offences punishable under Sections 109, 115(2), 85, 351(3) and 352 of the Bharatiya Nyaya Sanhita, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the - 5 - HC-KAR NC: 2026:KHC:27961 CRL.P No. 4833 of 2026 likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall mark his attendance on every alternate Sunday before the SHO of Nandini Layout Police Station, Bengaluru, between 10:00 a.m. and 1:00 p.m., for a period of one year from the date of his release. c) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; d) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; e) The petitioner shall not involve in similar offences in future; f) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
