JUSTICE LALITHA KANNEGANTI ORAL ORDER The present Writ Petition is filed seeking the following prayers: “a) Issue a writ in the nature of Mandamus directing Respondent No.2 to receive and register petition under the Section 23 of the Maintenance and Welfare of parents and Senior Citizens Act, 2007 forthwith in accordance with law; b) Direct Respondent No.2 to register, number, and consider the petition and dispose of the same within six months presented by the petitioner seeking urgent protection, welfare and safety measures in respect of Sri.Narayanappa Naik K.N., senior citizen, in an expeditious manner; c) Direct Respondent No.2 to consider the request for urgent interim protection and pass appropriate orders safeguarding the life, dignity, safety, medical welfare, financial security, and peaceful - 3 - HC-KAR NC: 2026:KHC:25325 WP No. 16002 of 2026 residence of the senior citizen pending disposal of the proceedings; d) Declare that the refusal on the part of Respondent No.2 to receive and entertain the petition solely on the ground of "vacation" is arbitrary, illegal, unsustainable, and contrary to the object and provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007; e) Pass such other order or direction as this Hon'ble Court deems fit, proper and necessary in the facts and circumstances of the case, in the interest of justice and equity." 2. It is the grievance of the petitioner that the petitioner has approached Assistant Commissioner under the Maintenance and Welfare of parents and Senior Citizens Act, 2007, and the Assistant Commissioner is refusing to receive the complaint of the petitioner on the ground that it is vacation period. 3. On instructions, it is submitted that the office of the Assistant Commissioner is very much working and there is no vacation. 5. Accordingly, the Writ Petition is disposed of directing respondent No.2 to consider the application filed by the petitioner under the Maintenance and Welfare of parents and Senior Citizens Act, 2007 in accordance with law. 6.
