JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.4 in Cr.No.47/2026 registered by Mandi Police Station, Mysuru City for the offence punishable under Section 22(C) of Narcotic Drugs & Psychotropic Substances Act, 1985 (for short 'NDPS') is before this Court in this Petition under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking regular bail. 2. Heard the learned counsel appearing for the petitioner and learned High Court Government Pleader on behalf of respondent-State. 3. FIR in Crime No.47/2026 was registered by Mandi Police Station, Mysuru City, for the aforesaid offence against Nuhed Khan and others, based on the first information dated 23.02.2026 received from Shabbir Hussen. During the course of investigation, petitioner was arrested and remanded to judicial custody on 23.02.2026. - 3 - HC-KAR NC: 2026:KHC:27413 CRL.P No. 4979 of 2026 4. The bail application filed by the petitioner before the Trial Court in Cr.No.47/2026 was rejected on 12.03.2026. Therefore, the petitioner is before this Court. 5. Material on record would go to show that on receipt of credible information on 23.02.2026 at about 11:00 a.m., raid was conducted to the alleged spot where some persons who had arrived in a white Innova car bearing Registration No.KA- 05 NK 7805 were making attempt to sell contraband articles to the public and accused Nos.1 to 4 were apprehended. From the possession of accused Nos.1 to 3, contraband articles allegedly MDMA totally weighing 82.68 grams was seized and from the dash board of the car, contraband articles allegedly MDMA totally weighing 31.28 grams was seized. Subsequently, accused Nos.1 to 4 were arrested and remanded to judicial custody. 6. Reading of material on record would go to show that 82.68 grams of contraband articles were seized from the possession of accused Nos.1 to 3 and no contraband article has been seized in the present case from the possession of accused No.4. Contraband article weighing 31.2 grams was seized from - 4 - HC-KAR NC: 2026:KHC:27413 CRL.P No. 4979 of 2026 the dash board of the car and the said car undisputedly belongs to accused No.1. 7. The petitioner aged about 19 years has no other criminal antecedents and he is in custody from 23.02.2026 onwards. Major portion of the investigation is completed. Continued detention of the petitioner in custody, who is aged 19 years is likely to have adverse impact on his future career. Rigour as provided under Section 37(1)(b) of the NDPS cannot be made applicable in the present case since the petitioner has no other criminal antecedents and there is no seizure of contraband article or any other incriminating material from the possession of the petitioner. Therefore, I am of the opinion that the prayer made by the petitioner for grant of regular bail has to be answered in the affirmative. 8. Accordingly, the following: ORDER (i) The Criminal Petition is allowed. (ii) The petitioner is directed to be enlarged on bail in Crime No.47/2026 registered by Mandi Police Station, Mysore - 5 - HC-KAR NC: 2026:KHC:27413 CRL.P No. 4979 of 2026 for the offences punishable under Section 22(c) of Narcotic Drugs & Psychotropic Substances Act, 1985, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) Petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) Petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) Petitioner shall not involve in similar offences in future; e) Petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
