Cr. Appeal (DB) No. 598 of 2026
This appeal is directed against the order dated 20.02.2026 passed by the learned Additional Sessions Judge-I, Pakur in B.P. No.50 of 2026 arising out of Pakur (Muffasil) P.S. Case No. 122 of 2024 whereby and whereunder the prayer for bail of the appellant has been rejected. It has been alleged that the appellant and others were slaughtering bovine animals at which the villagers had made a protest resulting in an assemblage of several persons who were involved in loot and arson. Submission has been advanced by the learned counsel for the appellant that the allegations against the appellant are general and omnibus in nature. It has further been submitted that one of the co-accused, who is
-2- named in the First Information Report, has been granted bail by a Coordinate Bench of this Court in Cr. Appeal (DB) No.616 of 2026.
Learned counsel adds that the appellant is in custody since 02.02.2026 and that the appellant is blind in both the eyes. Learned Spl.P.P has opposed the prayer for bail of the appellant. Regard being had to the fact that similarly situated co-accused has been granted bail, as noted above, we while setting aside the order dated 20.02.2026 passed by the learned Additional Sessions Judge-I, Pakur in B.P. No.50 of 2026 arising out of Pakur (Muffasil) P.S. Case No. 122 of 2024, direct the appellant to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pakur in B.P. No.50 of 2026. This appeal stands allowed and disposed of.
