ORAL ORDER
The present Writ Petition is filed seeking the following relief: (a) Issue a Writ of Certiorari or any other writ or
order or orders to set aside the Order, dated: 27.01.2026, in case No.MSC:109/2024 passed by the 1st Respondent, The Assistant Commissioner, Bengaluru Sub-Division, Bengaluru Urban District, V.V. Tower, Dr. Ambedkar Veedhi, Bengaluru, vide Annexure –E and thereby restore

the case No. MSC:109/2024 to dispose on merits, by considering the LR application, vide Annexure –D.
(b) To grant such other relief or reliefs as this Hon’ble Court deems fit to grant in the facts and in the circumstances of the case by allowing the above Writ Petition, in the interest of justice and equity.”

Learned counsel appearing for the petitioner submits that the petitioner's mother has filed an application under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 and during the pendency of the petition the mother died and the petitioner who is the daughter's son filed an I.A. to implead himself and that came to be dismissed by the Commissioner. Aggrieved thereby the petitioner is before this Court. Learned counsel for the petitioner submits that the petitioner's rights will be affected if this application is not allowed and further the Commissioner has failed to consider all the grounds that are raised.
3. Learned AGA appearing for the respondents submits that the Commissioner has rightly dismissed the

application. Under the Act the inter se disputes between the petitioner and other family members cannot be decided.
4. Having heard the learned counsel on either side, perused the material on record.
5. Under the Maintenance and Welfare of the Parents and Senior Citizens Act, 2007 the aggrieved party is a senior citizen or a parent. In this case, there are no orders passed by the Commissioner in favour of the senior citizen. During the pendency of the petition, the mother died. In those circumstances, if there are any disputes between the petitioner and the second respondent, his remedy is to approach the appropriate Forum for redressal of his grievance, but not before the Commissioner. In that view of the matter, this Court do not find any irregularity with the order impugned. However, liberty is reserved to the petitioner to avail the appropriate remedy.

6. Accordingly, this Court is passing the following:
ORDER (i) The Writ Petition is disposed of giving liberty to the petitioner to avail the appropriate remedy. (ii) This Court has not issued notice to respondent as no adverse orders are passed against the respondent. (iii) All pending I.A.s shall stand closed.
