… … Respondent(s) ------
CORAM : SRI ANANDA SEN, J. ------
For the Petitioner(s) : Mr. Siddharth Ranjan, Advocate
For the Respondent(s) : Mr. P.A.S. Pati, Advocate
------ 02/ 13th July, 2026
1.
Heard the parties.
2.
It is the grievance of the petitioner that the respondents were not giving possession of the land having Plot No. 1110 area 17 decimals and Plot No.346 (Part) having area 38 decimals of Khata No.77, Mauza-Ulda, East Singhbhum, which was the subject matter of the auction.
3.
Learned counsel for the respondents submits that they had gone to give possession but the petitioner did not cooperate and he rather remained absent.
4.
Learned counsel for the petitioner submits that since there was a discrepancy in the mutation slip of the land, the petitioner sought clarification which was not been clarified by the bank thus he did not remain present.
5.
Mutation is not a proof of title. Admittedly, the mortgage assets were with the bank and the bank auctioned it and the petitioner purchase the same. Both the parties admit that the land is a vacant piece of land without any construction and without any boundary. Thus, I direct the petitioner to immediately take possession over the land in question, as per the sale certificate, issued by the bank in favour of the petitioner and once the petitioner takes possession of the same, he will apply for fresh mutation before the concerned Circle Officer, who will

mutate the land in favour of the petitioner, strictly as per the sale certificate. The bank will not create hindrance in the entire procedure and it will be presumed that the bank has given the possession to the petitioner over the land, which is covered by the sale certificate.
6.
With the aforesaid observation and direction, this writ petition stands disposed of.
