[2026:RJ-JP:761] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No.16039/2025 Bhura S/o Shri Banay Singh, Aged About 26 Years, R/o Nagla Gujra, Midhakur, District Agra, U.P. ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Yogesh Singhal, Adv. For Respondent(s) For Complainant : : Ms. Arti Sharma, PP Ms. Saroj Singh, Adv. HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 09/01/2026 1. Apprehending his arrest in connection with FIR No.322/2024, registered at Police Station Chiksana, District Bharatpur, for the offence(s) under Sections 189(2), 115(2) and 126(2) of B.N.S., the accused-petitioner has preferred this criminal misc. bail application under Section 482 of B.N.S.S. 2. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in the present case. It is contended that the allegations levelled against the petitioner are omnibus in nature, without any specific role being attributed to him. It is further contended that a cross-case has also been lodged by the co-accused against the complainant-party. Learned counsel further argues that the concerned Medical Jurist has not opined that the injury sustained by the injured Jagbeer is dangerous to life. It is also contended that the parties have [2026:RJ-JP:761] (2 of 3) [CRLMB-16039/2025] arrived at amicable settlement. The custodial interrogation of the petitioner is not required and the petitioner is ready and willing to cooperate with the investigation, therefore, the anticipatory bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has submitted the factual report, the same is taken on record. 4. Leaned counsel appearing on behalf of the complainant concedes that the petitioner and the complainant-party have arrived at amicable settlement and also admitted that the cross case also lodged by the co-accused against the complainant-party and if the anticipatory bail to the petitioner is granted then the complainant-party has no objection. 5. Heard and perused the material available on the record. 6. In the factual report, it is stated that the injured Jagbeer Singh sustained injury at his head, however, the said injury has not been opined to be dangerous to life. Therefore, considering the nature of injuries sustained by injured Jagbeer Singh as well as the injuries sustained by the other injured persons, without further going into the merits of the case and looking to the fact that the custodial interrogation of the accused-petitioner is not required, the accused-petitioner is ready and willing to co-operate with the investigation, therefore, this Court deems it just and proper to allow the instant anticipatory bail application of the accused-petitioner. 7. Accordingly, the anticipatory bail application under Section 482 of B.N.S.S. is allowed and it is ordered that in the event of arrest of the accused-petitioner-Bhura S/o Shri Banay Singh, in connection with FIR No.322/2024, registered at Police Station [2026:RJ-JP:761] (3 of 3) [CRLMB-16039/2025] Chiksana, District Bharatpur, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or any police officer. (iii) that the petitioner shall not leave India without previous permission of the court. (PRAVEER BHATNAGAR),J Ashwani Kr Srivastava /-286
