W.P.(C) 14302/2026 & connected matters. Page 4 of 5 documents. 6. Mr. Joshi submits that, in the present cases, the petitioners themselves contend that the consolidation proceedings have already been concluded, and therefore, the judgment in Okaya, which permits registration subject to the pendency of consolidation proceedings and the rights of third parties, would not apply. He, however, does not have instructions as to the reasons for which registration of the documents has been declined at this stage. 7. In these circumstances, the appropriate course, in my view, would be to direct the concerned Sub-Registrars either to register the documents or to communicate the deficiencies, if any, to the concerned petitioners within a stipulated period, whereafter the petitioners would be at liberty to avail of their statutory remedies. 8. The petitions, alongwith the pending applications, are accordingly
disposed of with the following directions: a) If the consolidation proceedings are, in fact, still pending and the request for registration has been declined on that ground, the parties shall follow the procedure stipulated in Okaya and the orders passed in pursuance thereof. Registration shall not be denied merely for want of NOC/LSR, subject to the petitioners furnishing an undertaking on affidavit that they shall take the land subject to the outcome of the consolidation proceedings and subject to any third-party rights. Such affidavits shall be filed before this Court as well as before the concerned Revenue Authorities prior to registration of the documents. b) If the consolidation proceedings have already been concluded, or if This is a digitally signed order.
