The petitioner is apprehending his arrest in connection with Bhandra P.S. Case No.66 of 2024 dated 04.11.2024, registered for the offence under Sections 316(2), 318(4), 338, 336(3), 340(2), 308(5), 3(5) of the Bharatiya Nyaya Sanhita, pending in the Court of the learned Judicial Magistrate, 1st Class, Lohardaga. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case and even the petitioner is not named in the FIR. He further submits that in the FIR, the allegations are made against Majibullah Mirdaha @ Md. Majibullah of taking the tractor of the informant and assured him to give profit from the tractor and also to pay EMI of the tractor. He further submits that in the FIR itself, it has been stated that the said Majibullah Mirdaha @ Md. Majibullah has sold the said tractor to Lalsa Singh Bijhiya. He next submits that the petitioner is having no criminal antecedent. He also submits that the said Majibullah Mirdaha @ Md. Majibullah has been granted anticipatory bail by the Coordinate Bench of this Court in A.B.A. No.1128 of 2025. 4. Learned counsel appearing for the State opposed the prayer and submits that during the course of investigation, it has surfaced that showing ( 2026:JHHC:20921 ) -2- A.B.A. No. 3074 of 2026 the petitioner as owner of the tractor, the tractor has been sold and forged documents have been recovered from the possession of the person wherefrom the tractor in question has been recovered. 5. Considering that the petitioner is not named in the FIR and in the FIR itself, it has been stated that Majibullah Mirdaha @ Md. Majibullah has taken the tractor of the informant and assured him to give profit from the tractor and also to pay EMI of the tractor and in the FIR, it has also been stated that the said Majibullah Mirdaha @ Md. Majibullah has sold the said tractor to Lalsa Singh Bijhiya without consent of the informant and further the said Majibullah Mirdaha @ Md. Majibullah has been granted anticipatory bail by the Coordinate Bench of this Court in the aforesaid A.B.A. and further, it has been pointed out that the petitioner is having no criminal antecedent and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Lohardaga in connection with Bhandra P.S.
