The petitioners herein are assailing the proceedings initiated by the Assistant Registrar of Co- operative Societies, Pandavapura Sub-Division, Pandavapura, (Annexure-L) Respondent No.2 herein against the petitioners herein. 3. Sri.B.M.Kenchegowda, learned counsel appearing for the petitioners submitted that the issuance of the notice at Annexure-K series is erroneous on the ground that the petitioners herein, who are the directors of the Society have passed a resolution as per Annexure-J, - 5 - HC-KAR NC: 2026:KHC:14208 WP No. 32357 of 2025 which is in accordance with law, however, the Respondent No.2 has initiated action against the petitioners, which requires to be interfered with in this case. 4. Per contra, Sri.Yogesh D Naik, learned Additional Government Advocate appearing for Respondent Nos.1 and 2 submitted that, the petitioners (Directors of Society), ought to have taken prior permission while passing the Resolution at Annexure-J. Learned AGA further submitted that the Respondent - Society, particularly, the directors (petitioners) have violated the provisions of the Karnataka Co-operative Societies Act, 1959, and therefore, sought for dismissal of the petition. 5. In the light of the submissions made by the counsels appearing for the parties, since the matter is pending consideration before Respondent No.2, therefore, I am of the opinion that no interference is called for insofar as the proceedings initiated against the petitioners under Section 29(c) of the Karnataka Co-operative - 6 - HC-KAR NC: 2026:KHC:14208 WP No. 32357 of 2025 Societies Act with respect to the issuance of the notice is concerned. Respondent No. 2 is directed to complete the entire proceedings expeditiously. It is also made clear that this Court has not expressed any opinion on the merits of the case.
