Learned counsel for the petitioner submits that the petitioner is holding the post of Controller of Examination in Rajasthan University of Health Sciences, where after establishing the University vide order dated 09.11.2004, one post of Controller of Examination was created and sanctioned in the pay scale of Rs.12,000-16,500/- (Grade Pay-7600), which at the relevant time was equal to the pay scale admissible to the post of Controller of Examination in other Government Universities in the State of Rajasthan. 3. Learned counsel for the petitioner submits that such pay scale has been arbitrarily reduced and instead of pay scale of 12,000-16,500/- (Grade Pay-7600), lower pay scale of 10,650- 15,850/- (Grade Pay-6800) has been sanctioned by the respondent- University. He submits that so far as officersof the University as well as Directorate of Medical Education Department is concerned, they fundamentally agree that the post of Controller of Examination should carry the same pay scale, which is applicable in the other Government Universities in the State of Rajasthan such as Maharana Pratap University of Agriculture and Technology, Udaipur, Rajasthan University of Veterinary and Animal Sciences, Bikaner and Rajasthan Technical University, Kota etc. However, the proposal sent by Directorate of Medical Education, Jaipur has been turned down by the Finance [2026:RJ-JP:4956] (3 of 3) [CW-19218/2025] Department without passing any speaking order and without pointing out any considerable distinction between the post of Controller of Examination available in Rajasthan University of Health Sciences and other Government Universities in State of Rajasthan. 4. On advance copy, Mr. Anand Saini, Mr. Nikhil Saini and Mr. Lakshay Bajad, Advocates appeared on behalf of the respondents and accept the notices. 5. In the light of above, where erstwhile pay scale admissible to the post of Controller of Examination has been stated to be equal to the post of Controller of Examination in other Universities, at this stage, this Court deems it just and proper to direct the petitioner to make a representation along with all necessary documents before the respondent- Finance Department, Government of Rajasthan, Secretariat, Jaipur as well as the Secretary, Medical Education, Government of Rajasthan, Secretariat, Jaipur. Representation shall be considered by the Secretary, Finance Department and after examining the facts as well as the applicability of two different pay scales for the same post in different Universities of the State of Rajasthan, speaking order shall be passed within a period of 60 days from the date of receipt of representation along with a certified copy of this order. 6. Writ petition stands disposed of, accordingly. 7. Pending application(s), if any, also stand(s), disposed of. (ANAND SHARMA),J DIVYA /28
