The petitioner is apprehending his arrest in connection with Bariyatu P.S. Case No. 06 of 2026, registered under sections 15(c), 18(b), 22, 25, 29 of NDPS Act, pending in the Court of learned Sessions Judge-cum-Special Judge, NDPS at Latehar. 3. Learned counsel for the petitioner submits that false allegation is made of cultivation of poppy plant in the forest area. He next submits that the said land is not belonging to the petitioner and petitioner has got no criminal antecedent which is disclosed in para 19 of the petition and he next submits that the co-accused persons have been granted anticipatory bail in ABA No.2314 of 2026. On these grounds, he submits that the petitioner may kindly be provided privilege 2026:JHHC:20841 2 of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that allegations are there of cultivation of poppy plant in the forest area. 5. Considering that land is of the forest department and petitioner has got no criminal antecedent which is disclosed in para-19 of the petition and the co-accused persons have been granted anticipatory bail as aforesaid, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Sessions Judge-cum-Special Judge, NDPS at Latehar, in connection with Bariyatu P.S.
