Order No. 02
Dated 10th July, 2026
Heard the learned counsel for the respective sides.
This application is directed against the judgment dated 04.05.2026 passed by the learned Additional Sessions Judge-I-cum-Children Court, Deoghar, in Criminal (Juvenile Bail) Appeal No. 27 of 2026, whereby and whereunder, the
order dated 04.04.2026 passed by the learned Principal Magistrate, Juvenile Justice Board, Deoghar in connection with Kunda P.S. No. 212 of 2025, rejecting the prayer for bail of the petitioner, has been affirmed.
It has been alleged that the son of the petitioner was shot dead by some of the accused persons.
From a perusal of the First Information Report, it clearly reveals that though the petitioner is named in the First Information Report, but the allegation of firing at the son of the informant is attributed to Shivam Mishra, Sagar and Chandan.
Submission has been advanced by the learned counsel for the petitioner that the petitioner is in remand home since 03.11.2025. It has further submitted that several of the co-accused persons including Dibyansh Jha who has been named in the First Information Report has been granted bail in B.A. No. 310 of
2026.
Learned Spl.P.P. for the State has opposed the prayer for bail of the petitioner.
There does not seem to be any overtact alleged against the petitioner as the same is attributed to the three persons who have been categorically
mentioned in the First Information Report. The petitioner seems to have been implicated merely on the ground of his presence at the place of occurrence. Several of the co-accused persons similarly situated have been granted bail.
Regard being had to the above, while setting aside the judgment dated 04.05.2026 passed by the learned Additional Sessions Judge-I-cum-Children Court, Deoghar, in Criminal (Juvenile Bail) Appeal No. 27 of 2026 and the order dated 04.04.2026 passed by the learned Principal Magistrate, Juvenile Justice Board, Deoghar in connection with Kunda P.S. No. 212 of 2025, the petitioner is
directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Principal Magistrate, Juvenile Justice Board, Deoghar in connection with Kunda P.S. No. 212 of 2025 (Enquiry No. 214 of 2026), subject to the condition that the father of the petitioner shall ensure the safe keep of the petitioner and shall also ensure that the petitioner is not allowed to mingle with any antisocial elements.
This application stands allowed.
