The instant CRMP u/S 528 of BNSS has been filed by the petitinoer for restoration of CRMP 2926/2023, which was dismissed on the ground of non- compliance of the order passed by this Court. 2. Learned counsel for the petitioner submits that the petitioner filed a petition under Section 482 of the Cr.P.C for quashing the FIR No. 90/2020 registered at Police Station Kotra Road, Raigarh and Charge-sheet No. 02/2021 filed before the Chief Judicial Magistrate Raigarh and the consequential criminal proceeding pending before the Judicial magistrate First Class, Raigarh bearing Criminal Case No. 1629/2021. During the proceeding, respondent No. 1 to 4 and respondent No. 5/Complainant filed their reply. 3. It is further submitted that when the matter was listed on 15.12.2025, this Court granted two weeks’ time to file rejoinder subject to payment of cost of Rs. 10,000/- to respondent No. 5 on or before 19.12.2025, failing which the petition was to stand automatically dismissed without further reference to the Bench. Learned counsel submits that in compliance of the aforesaid order, the petitioner paid the said amount of Rs. 10,000/- to learned counsel appearing for respondent No. 5 on 16.12.2025 itself and also filed the receipt before the Registry along with a covering memo on the very same day. Learned counsel further submits that after preparation of the rejoinder, when the petitioner approached the filing section for filing the same, he was informed that the petition had already been dismissed for alleged non-compliance of the conditional order dated 15.12.2025. It is contended that the dismissal of the petition is wholly inadvertent and contrary to the record, inasmuch as the petitioner had duly complied with the condition imposed by this Court well 3 within the stipulated time. Thus, he would pray for restoration of the CRMP to its original number i.e. CRMP No. 2926/2023. 4. Considering the submissions made by learned counsel for the petitioner and upon perusal of the documents annexed with the application, this Court is satisfied that the petitioner had duly complied with the conditional order dated 15.12.2025 by depositing the cost amount within time and filing the receipt thereof before the Registry. The dismissal of the petition for non-compliance, therefore, appears to have occurred on account of inadvertence. 5. Accordingly, the application for restoration is allowed. The petition is restored to its original number i.e. CRMP No. 2926/2023 subject to all just exceptions. 6.
