In this application, the petitioner has been roped under Section 376/417/493/506 of the IPC corresponding to SPL-TR no. 170 of 2018. Being aggrieved by the inordinate delay in making charge hearing by the court below, learned counsel for the petitioner submits that in this case, the charge-sheet was submitted against the present petitioner on 26th June, 2018. Since then for about eight years, the case is fixed for charge hearing and the matter is getting adjourned day after day for no fault of the petitioner. Therefore, though in this application, a different prayer has been made but the learned counsel for the petitioner on instruction submits that an appropriate direction may be passed upon the court below to conclude the charge hearing within a reasonable period of time. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is 2 innocuous and also considering the fact that the charge hearing is pending before the court below for about eight years, I find that the prayer made by the petitioner is required to be allowed to secure the ends of Justice. I am told that the next date is fixed on 27.7.2026 for appearance and charge hearing. In such view of the matter, the instant application being CRR 3194 of 2025 is hereby disposed of with a direction upon the court below to make every endeavour to conclude the charge hearing on the next date i.e. on 27.7.2026 or preferably within a period of three months thereafter, without granting any unnecessary adjournment to either of the parties. This order is passed invoking this court’s jurisdiction under Section 529 of the BNSS.
