The petitioner is in custody since 17.06.2025 and charge-sheet has already been submitted, the same is taken on record. The trial of the case may take considerable time, therefore, the second bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the second bail application and contended that the petitioner is a habitual offender and against him 10 cases under various offences were registered, out of which 5 cases are registered under the NDPS Act. It is alleged against the petitioner that he provided his vehicle to the other co-accused Rahul, Subhash, Lallan and Nilesh in facilitating the transportation of commercial quantity of 567 Kg of poppy straw to another vehicle, therefore, considering the gravity of the offence, the second bail application of the accused- petitioner may be dismissed.. 4. Heard and perused the material available on record. 5. Considering the fact that the recovery of alleged contraband article 567 Kg of poppy straw was effected from the other co- accused Rajkumar and apart from the statement of owner of the vehicle, there is no substantive evidence available on record indicating the fact that the petitioner supplied the contraband article containing 567 Kg of poppy straw to the other co-accused Rajkumar and was involved in escorting the vehicle with the other co-accused namely: Rahul, Subhash, Lallan and Nilesh. Though, there are various cases registered against the petitioner, however, considering the above facts and also considering the fact that the recovery of contraband article was effected from the other co-
[2026:RJ-JP:79] (3 of 3) [CRLMB-15917/2025] accused Rajkumar from another vehicle, I deem it just and proper to enlarge the accused-petitioner on bail. 6.
