[2026:RJ-JP:7576-DB] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR D.B. Civil Contempt Petition No. 1211/2024 In D.B. Civil (PIL) Writ Petition No.7169/2016 Babu Lal Meena S/o late Shri Panchuram Meena, Aged About 64 Years, resident of Dhani Kaythawali Tan Amai Tehsil Kotputli District Jaipur (Presently District Kotputli Behror) (Raj). ----Petitioner Versus 1. Bharat Lal Meena, The Then Additional SP, SC/ST Cell, Police Commissionerate, Jaipur, Presently Posted At Police Head Quarter, Lalkothi, Jaipur (Rajasthan). 2. Yogesh Goyal, The Then DCP (South), Jaipur, Police Commissionerate, Jaipur, Presently Posted As Superintendent Of Police, Udaipur (Rajasthan). 3. State Of Rajasthan, Through Principal Secretary, Department Of Home, Secretariate, Jaipur (Raj.). ----Respondents For Petitioner(s) : Petitioner in-person For Respondent(s) : Mr. Vishnu Dutt & Ms. Epsa Nangalia for Mr. Bhuwnesh Sharma, AAG HON'BLE MR. JUSTICE SUDESH BANSAL HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 17/02/2026 1. By means of filing instant civil contempt petition under Section 12 of Contempt of Courts Act, 1971 read with Articles 215 & 225 of Constitution of India, petitioner has alleged disobedience of a stay order dated 28.03.2023 passed during pendency of D.B. Civil Writ Petition No.7169/2016. 2. Fundamentally, the case of petitioner is that vide order dated 28.03.2023, further investigation in FIR No.19/2023 registered at [2026:RJ-JP:7576-DB] (2 of 4) [CCP-1211/2024] Police Station- Ashok Nagar, Jaipur was stayed and the Police Authorities were directed not to proceed with investigation, yet the investigation has been culminated into negative final report. 3. At the outset, it is noteworthy that D.B. Civil Writ Petition No.7169/2016 was filed by State Bank of India and department of police including respondent No.1, contemnor was not party to the writ petition. The factual backdrop filing the writ petition was that the petitioner was compulsorily retired from the bank and thereafter, he has filed various litigations and dragged the bank and 47 officers into frivolous and vexatious litigations. In that context, bank made a prayer to declare the petitioner – Babu Lal Meena, as vexatious litigant. The writ petition has finally been allowed vide judgment dated 30.10.2025 and in terms of Section 3 of the Rajasthan Vexatious Litigation (Prevention) Act, 2015, petitioner has been declared as vexatious litigant and it has been held that no proceedings (civil or criminal) shall be continued by such person in the High Court or any other Court, subordinate thereto and if he wants to initiate any proceedings, he would first have to seek leave of the Court and move an appropriate application. A copy of final judgment/ order dated 30.10.2025, produced by respondent, is taken on record. 4. On issuance of notice of contempt to respondent No.1, reply has been filed and it has been stated by respondent No.1 that investigation in FIR No.19/2023 had already been done by previous Investigating Officer, prior to communication of the stay order dated 28.03.2023 and respondent No.1 only verified the correctness of that investigation, hence, he is not liable for any disobedience of the stay order dated 28.03.2023. [2026:RJ-JP:7576-DB] (3 of 4) [CCP-1211/2024] 5. Petitioner, who is present in person, has filed counter to the reply, pointing out that the stay order dated 28.03.2023 was communicated in the police department on 05.04.2023 but despite that, verification of the investigation in FIR No.19/2023 was made by respondent No.1. Petitioner pointed out that in the note of verification, wordings “during investigation” has been used, hence, it may not be assumed to be correct that no further investigation was made by respondent No.1, rather his submission is that respondent No.1 be held guilty for flouting the stay order passed by this Court and be suitably punished. 6. Heard. Considered. 7. From the record, we have noticed that prior to this contempt petition, petitioner has already filed a D.B. Civil Contempt Petition No.985/2024, raising the similar issue of disobedience of stay order dated 28.03.2023 in respect of conducting investigation in FIR No.19/2023. The previous contempt petition was dismissed as withdrawn vide order dated 04.11.2024. In the order dated 04.11.2024, although petitioner was granted liberty to get legal aid, but no liberty for filing a fresh contempt petition after obtaining legal aid, was granted. Hence, this second contempt petition has been filed without accrual of fresh cause of action and second contempt petition is impermissible in law. 8. That apart on merits, we find the explanation of respondent No.1 as just, because from the record it is clear that investigation in the FIR No.19/2023 had already been concluded even prior to passing of the stay order dated 28.03.2023 and nothing has been placed on record to establish that after communication of stay order in the police department, further investigation was made [2026:RJ-JP:7576-DB] (4 of 4) [CCP-1211/2024] by respondent No.1 in FIR No.19/2023. More so, in the final order/ judgment dated 30.10.2025 whereunder, petitioner has been declared a vexatious litigant, FIRs lodged by petitioner and registered at as many as 9 police stations, including Police Station- Ashok Nagar, Jaipur where the FIR No.19/2023 is also registered, were taken into consideration. In that view as well, the proceedings of present contempt petition, are not liable to be continued and application to continue the proceedings of this contempt petition is hereby dismissed. 9. As a result, the proceedings of present contempt petition are hereby closed and the contempt petition stands dismissed. Notices of contempt, stand discharged accordingly. 10. Pending application(s), if any, stand(s) disposed of. (ANIL KUMAR UPMAN),J (SUDESH BANSAL),J CHARU SONI /Sachin/ 10
