Affidavit of service filed by the petitioner is taken on record. The respondents are not represented despite service. The petitioner submits that being the recorded owner of the plots in question, the petitioner applied for permission to raise construction therein. Though the sanctioned plan has been approved by the Nirman Sahayak and the civil engineer upon consideration of the relevant documents produced by the petitioner, the Pradhan, Mahishthli Gram Panchayat, being the 5th respondent herein has not signed the same for which the sanctioned plan has not been granted to him. The petitioner submitted a representation before the 5th respondent in this regard on 11th July, 2025 and seeks consideration of the same. In view of the above, the 5th respondent is directed to consider and dispose of the representation submitted by the petitioners within two weeks from the date of communication of this order upon considering the relevant documents submitted by the petitioner as well as the endorsement of the Nirman Sahayak and the civil engineer, in accordance with law.
2 The decision taken by the authority shall be communicated to the petitioner within a week thereof. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
