ORAL ORDER
On 05.06.2026, this Court had passed the following
order:
"Learned counsel for the petitioners submits that respondent No.3-Society had originally filed a complaint on 09.03.2019, against the petitioner No.1-Nanjundaiah and one Mohan Kumar, which was registered in Crime No.40/2019 for the offences punishable under Sections 406, 420 of IPC, which has been quashed vide order dated 07.03.2022 in Crl.P.No.4990/2019.
2. Thereafter, respondent No.3-Society filed yet another complaint on 12.07.2021 (19.07.2021) against the petitioners herein to the Superintendent of Police, Millers Road and pursuant to which, petitioners herein were called for and their statements were recorded and no progress thereafter was made, in any manner whatsoever.
3. That the respondent No.3-Society had apparently made another representation before the Home Minister, furnishing the very same copy of the complaint dated
12.07.2021. That the pursuant to the said subsequent complaint/representation as per Annexure-G, the matter is now referred to J.C.Nagar Police Station, who has issued a notice to the petitioners.
4. Petitioner being apprehensive of they being subjected for unwarranted harassment, pursuant to the subsequent complaint/ representation as per Annexure-G are before this Court.
5. Learned counsel for the petitioners submits that the respondents are subjected to unwarranted enquiry on a very same complaint by two different authorities, one by the Superintendent of Police, Millers Road and other by the J.C. Nagar Police. Hence, the petition.
6. Learned AGA, at the juncture seeks a week's accommodation to submit regarding status of the aforesaid complaint.
7. List this matter on 10.06.2026.
8. Interim order granted earlier is extended till next date of hearing."

2. Learned AGA on instructions submits that the respondent-authorities will pursue only the complaint dated 12.07.2021 (19.07.2021), which was filed before the Superintendent of Police, Millers Road, Bangalore Rural District, Bangalore, pursuant to which statements of the petitioners have already been recorded.
3. He submits that the subsequent complaint though of the same date namely, 12.07.2021 as per Annexure-G submitted before the Home Minister, who in turn has referred the matter to J.C.Nagar Police Station, Bangalore, would not be pursued.
4. Submission is taken on record.
5. Accordingly, the following;
ORDER (i) The petition is disposed of. (ii) The letter/complaint dated 12.07.2021 as per Annexure-G and consequent proceedings thereafter are hereby quashed.

(iii) The respondent-authorities are however at liberty to pursue and proceed with further investigation, if not already completed in respect of complaint dated 12.07.2021 (19.07.2021) filed against the petitioners before the Superintendent of Police, Millers Road, Bangalore Rural District, Bangalore.
