This petition has been filed for restoration of WPC No.5341/2021, which was dismissed in default vide order dated 12/03/2026. 3. Learned counsel appearing for the petitioner submits that due to some clerical mistake while checking the cause-list in the office, it could not be traced out that the petition was listed for final hearing, owing to which, none NARESH KUMAR KAMDE Digitally signed by NARESH KUMAR KAMDE Date: 2026.05.15 16:44:06 +0530 2 was appeared on the said day. It is contended that the said mistake has been committed bonafidely and, there was no malafide intention behind it, therefore, the alleged default may kindly be condoned, in the interest of justice. 4. On the other hand, learned counsel appearing for the respondent No.5 has opposed the same orally and submits that the petitioner has deliberately not appeared on the said day, therefore, the instant petition as framed be dismissed. 5. Having considered the aforesaid contention of the parties, considering further the reasons assigned by the petitioner, which is duly supported by an affidavit, I am, therefore, inclined to allow the same. 6. Accordingly, the petition is allowed and, the petition, being WPC No.5341/2021, is directed to be restored to its original number, subject to cost of Rs.2,500/- payable to the High Court Legal Services Committee, through its Secretary Member, within a period of seven working days from today. 7.
