1. Accused Nos.1 to 3 in Crime No.45/2026 registered by the Bagepalli Police Station, Chickballapura, for the offences punishable under Sections 420, 471, 465 of IPC and Section 81 of the Registration Act, 1908 are before this Court in this

Criminal Petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard learned counsel for the parties. 3. FIR in Crime No.45/2026 was registered by the Bagepalli Police Station, Chickballapura, for the aforesaid offences alleged against Venkatappa and others based on the first information dated 12.02.2026 submitted by Suresh Handi Gundha, Sub-Registrar of Bagepalli Police Station. Apprehending arrest in the present case, petitioners had filed Crl.Misc.No.138/2026 before the jurisdictional Sessions Court, at Chikkaballapura seeking anticipatory bail, which was rejected on 22.04.2026. Therefore, they are before this Court. 4. A perusal of the first information would go to show that Smt. Anuradha S.V., had approached the office of Inspector General of Registration and Commissioner of Stamps, Bangalore and had submitted a complaint alleging that the Will dated 22.12.1968, executed and registered in the office of Jurisdictional Sub-Registrar in respect of properties bearing Survey Nos.302/6, 312/1, 312/2, 312/4, 331/1, 331/2 and

323/2 of Sarjapur Village, Anekal Taluk is a concocted document. It appears that the said complaint was forwarded to the office of Sub-Registrar, Bagepalli, who in-turn after verifying the documents had approached the Bagepalli Police Station and submitted a first information based on which, FIR in Crime No.45/2026 has been registered for the aforesaid offences. 5. Allegation in the first information is that Late. Munishamappa S/o. Venkatappa, who had executed the aforesaid Will had left out his sons and had executed the said Will in favour of his brother's son-Venkatappa and therefore, the said Will was executed under suspicious circumstances. Accused Nos.1 and 3 were not even born as on the date of execution and registration of the aforesaid Will. The alleged offences are triable by the Court of Magistrate and maximum punishment for the said offences is imprisonment for a period of seven years. Petitioners have undertaken to co-operate the police for the purpose of investigation. All the relevant documents are in the custody of the first informant.

these circumstances, I am of the view that the prayer for grant of anticipatory bail is to be answered in the affirmative. 6. The petition is allowed. The respondent – Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.45/2026 registered by the Bagepalli Police Station, Chickballapura, for the offences punishable under Sections 420, 471, 465 of IPC and Section 81 of the Registration Act, 1908, subject to the following conditions: a) The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond before the concerned Court, for a sum of Rs.1,00,000/- with two sureties each for the likesum to the satisfaction of the investigating officer. b) Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. c) Petitioners shall not tamper with the prosecution witnesses and they shall co-operate
