1. By way of the present petition, the petitioner has prayed for the following reliefs: 10.1 Call for the entire records of the case from the authorities concerned for its kind perusal. 10.2 To direct the respondent authorities to take appropriate action against the respondent no. 5 and immediately stop and remove the on-going unauthorized/illegal construction of exit gate made by him over the land (about 10 square feet area in north side) at the front space land of the petitioner’s house bearing piece of Khasra No. 1297/1, area 1450 square feet, in the interest of justice. 10.3 To pass any other relief, which this Hon’ble High Court deems fit and proper be also awarded. 2. Learned counsel for respondent no. 2 to 4 submits that on the application filed by the petitioner the matter has been examined
3 and it was found both the petitioner as well as respondent no. 5 has encroached upon the land of municipal corporation. As such appropriate action is being taken against them in accordance with law. He further submits that notices have already been issued and construction as alleged by petitioner against respondent no. 5 has already been stayed. 3. Considering the aforesaid aspect of the matter, the respondent no. 3 to 4 is directed to issue notice to the concerned parties and pass appropriate order in accordance with law after giving them due opportunity of hearing.
In case the petitioner is aggrieved by any such order, the petitioner is at liberty to file appropriate application before appropriate authority. It is directed than till then no coercive step shall be taken by the respondent authorities against the petitioner as well as respondent no. 5. 4. With the aforesaid direction, the present petition is disposed of. Sd/-
