Mr. Kishore Mukherjee, Mr. Ahitagni Dey …for the petitioner In this application the petitioners have prayed for a direction upon the Court below for expeditious disposal of the protest petition filed by the opposite party/complainant. Being aggrieved by the inordinate delay in disposal of the said application, learned Counsel for the petitioners submits that the charge-sheet in this case was submitted on 29th August, 2020 and after almost 5 years i.e. on 7th August, 2025, the instant protest petition (Narazi petition) was filed when the trial started. However, the Court below has kept the said application pending since then and for which petitioners have prayed for appropriate direction upon the Court below. I am told that the next date is fixed for hearing the said petition on 27.05.2026. Having heard learned Counsel for the petitioners and that the prayer made by the petitioners is innocuous, I find that the same is required to be allowed for securing the ends of justice. In view of above, the instant application being CRR 636 of 2026 is hereby disposed of with a direction upon the Court below to make every endeavour to dispose of the opposite party’s protest 2 petition dated 07.08.2025 on the next date of hearing, i.e. on 27.05.2026 or preferably within a month thereafter and then he will make his best effort to expedite the final hearing of the criminal proceeding without granting any unnecessary adjournment to either of the parties.
