Learned counsel for the petitioner, after arguing for some time, seeks permission of this Court to withdraw the present petition with liberty to avail the statutory remedy available under Section 21(4) of the C.G. Panchayat Raj Adhiniyam, 1993 (for short, ‘Adhiniyam, 1993’) before the concerned Collector. 2. It is submitted that the petitioner was elected as Sarpanch of Gram Panchayat Durumgarh, District Bilaigarh-Sarangarh, and the impugned no-confidence motion dated 20.04.2026 was passed against her in proceedings initiated under Section 21(1) of the Adhiniyam, 1993. Learned counsel for the petitioner submits that though various grounds have been raised in the present petition regarding the manner in which the no-confidence proceedings were conducted, including denial of adequate opportunity of hearing and alleged irregularities in counting of 3 votes, however, since an efficacious alternative statutory remedy is available under Section 21(4) of the Adhiniyam, 1993, the petitioner may be permitted to approach the concerned Collector. 3. Considering the submission made by learned counsel for the petitioner and taking note of the fact that the no-confidence motion was passed on 20.04.2026 and the petitioner has directly approached this Court without availing the remedy provided under Section 21(4) of the Adhiniyam, 1993, this Court is not inclined to entertain the present petition. 4. Accordingly, the petitioner is granted liberty to approach the concerned Collector by filing appropriate proceedings under Section 21(4) of the Adhiniyam, 1993. 5.
