Heard the parties. The petitioner has moved this Court for grant of bail in connection with Marafari P.S. Case No.63 of 2025 corresponding to G.R. Case No.1267 of 2025 registered for the offences punishable under Sections 103(1), 3(5) & 310(3) of the BNS, 2023 and under Section 25(1- b)a/26/27/35 of Arms Act. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused person has committed murder of husband of the informant namely Mantu Das. It is next submitted that the allegations against the petitioner are all false. It is then submitted that so far 11 witnesses have been examined during the trial, the copy of the certified copy of the depositions of whom have been annexed in this bail application and in their depositions, none of the witnesses have stated anything about the petitioner; to implicate him in this case. It is also submitted that the co-accused has already been granted bail. It is further submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the informant/victim or the witnesses of the case in any manner during
the trial of the case. It is lastly submitted that the petitioner has been in custody since 12.08.2025 as mentioned in para-27 and the petitioner has no criminal antecedent as mentioned in para-28 of this bail application. Hence, it is submitted that the petitioner be admitted to bail. The learned Spl.P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioner on bail.
Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Bokaro in connection with Marafari P.S. Case No.63 of 2025 corresponding to G.R. Case No.1267 of 2025 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the informant or witnesses of the case in any manner during the trial of the case.
