ORAL ORDER
Petitioner the father of one Venkatapathy N, whose dead body was found on 23.11.2018 by the side of Mavallipura road, had filed a complaint seeking investigation into the matter before the respondent No.4-police, which was registered in Crime No.278/2018 for the offence punishable Sections 302 and 201 of IPC, is before this Court seeking following reliefs;

"(a) Issue a writ in the nature of Mandamus or any other appropriate writ, order or direction and direct the respondents to transfer the Investigation of the case registered as per Annexure-A and B in Crime No.278/2018 for the offence punishable under Section 302 and 201 of IPC from the respondent No.4 to the respondent No.5 in the interest of justice and equity.
(b) Issue any other writ, order or direction as this Hon'ble Court deems fit on the facts and circumstances of the case to meet the ends of justice."
2. Learned AGA today has filed a memo along with following documents;
(i) Copy of the FIR dated 26.11.2020,
(ii) Copy of the Notice dated 23.11.2020,
(iii) Copy of the 'C' report, and
(iv) Copy of the Postmortem report dated 24.11.2018.
3. Perusal of 'C' report would indicate that despite best efforts by the respondent No.4-police, they have not been able to trace the accused persons. As such, a request is made to consider the case for time being 'as closed' for not being able to trace the accused persons.
4. Learned AGA submits that if in the event of respondent No.4- police coming across any information with regard to the persons and reasons for cause of death of the

deceased- Venkatapathy N, necessary action in the matter will be taken.
5. Submission is taken on record.
6. In that view of the matter, since a 'C' report as to the above effect has already been filed before the Magistrate, reserving liberty to the petitioner for availing such remedy as may be available under law, including seeking necessary direction from the Magistrate in the matter, petition is
disposed of.
