04/14.07.2026 Heard learned counsel appearing for the petitioners, learned counsel appearing for the State and learned counsel appearing for the informant.
2. This application has been confined only for petitioner nos. 1 and 4 vide
order dated 12.05.2026 as petitioner nos. 2 and 3 have already been apprehended.
3. The petitioner nos. 1 and 4 are apprehending their arrest in connection with Telaiya P.S. Case No.375 of 2025, registered for the offence under Sections 61(2), 316(2), 318(4), 115(2), 126(2), 127(2), 352, 351(2), 308(5), 336(3), 338, 339, 340(2), 3(5) of the BNS, 2023, pending in the Court of the learned A.C.J.M., Koderma.

Learned counsel appearing for the petitioners submits that petitioner nos. 1 and 4 have been falsely implicated in the case. He further submits that they are in possession of the land and false allegations are made of encroaching upon the forest land. He also submits that the allegation of

demand of extortion money of Rs.2 Crores is also false. On these grounds, he submits that anticipatory bail may kindly be granted.

Learned counsel appearing for the State and informant jointly opposed the prayer and submit that even the D.F.O. in his report has stated that the petitioners’ plot number is 7941, whereas, encroachment has been made in plot number 7395 and that has come in the case diary. They further submit that two of the independent witnesses have supported the prosecution case and that has also come in the case diary.

Considering that the allegations are there against petitioner no.1 of operating saw mill on the land which was not prescribed in the license provided to him and even the report of D.F.O. is also there, wherein, it has been stated that the petitioners’ plot number is 7941, whereas, encroachment has been made in plot number 7395 and further, the allegation of demand of extortion money is also there against petitioner no.1 and in view of that, I am not inclined to extend the privilege of anticipatory bail to petitioner no.1, namely, Ashok Kumar Bhadani and, as such, his prayer for anticipatory bail is, hereby, rejected.
7. So far as petitioner no.4 is concerned, she is a lady. Prima facie, the allegation of extortion appears to be false against her. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to petitioner no.4, namely, Alpna Devi.
8. Accordingly, petitioner no.4, namely, Alpna Devi is directed to surrender before the learned Court within three weeks from today and in the event of her arrest or surrender, she shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like

amount each to the satisfaction of learned A.C.J.M., Koderma in connection with Telaiya P.S. Case No.375 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
9. Accordingly, this application is partly allowed and disposed of.
10. Interim order, granted earlier vide order dated 12.05.2026, is vacated.
