JUSTICE B M SHYAM PRASAD ORAL ORDER The petitioner has a dispute with the respondents on the supply covered under the Agreement dated 17.09.2021 [Annexure-B] which has the agreement for arbitration in the following terms: - 3 - HC-KAR NC: 2026:KHC:26152 CMP No. 488 of 2025 “Dispute Resolution: Any dispute or difference whatsoever arising between the parties out of or relating to the construction, meaning, scope operation or effect of this contract or the validity or the breach thereof shall be settled by arbitration to be decided by a sole arbitrator to be governed by the Arbitration and Conciliation Act, 1996. The venue of arbitration shall be Bengaluru, and the arbitration proceedings shall be conducted before the Arbitration and Conciliation Centre at Khanija Bhavan Bengaluru, and the arbitrator shall be appointed from among the panel of arbitrators at the Arbitration and Conciliation Centre.” The petitioner has caused notice dated 04.07.2025 [Annexure-G] raising a claim for Rs.13,51,646/- calling upon the respondents to concur with the appointment of a retired District Judge as a sole arbitrator who could enter reference of the dispute at the Arbitration and Conciliation Center [Domestic and International], Bengaluru. The respondents are served with the notice and have remained absent and in fact they have not caused - 4 - HC-KAR NC: 2026:KHC:26152 CMP No. 488 of 2025 any reply to the notice of arbitration. This Court is persuaded to opine that there is an arbitral dispute and an agreement for resolution of the arbitral dispute. Hence, the following: ORDER [A] The petition is allowed, and Shri. Vishwanath V. Angadi, a retired District Judge, is appointed as the sole arbitrator to enter reference of the dispute between the petitioners and respondents and conduct the proceeding at the Arbitration and Conciliation Centre [Domestic and International], Bengaluru according to the Rules governing the Arbitration and Conciliation Centre [Domestic and International], Bengaluru.
