Heard learned counsel appearing for the petitioners, learned counsel appearing for the State and learned counsel appearing for the informant. 3. The petitioners are apprehending their arrest in connection with Rikhiya P.S. Case No.18/2026, registered for the offence under Sections 115(2), 126(2), 109(1), 308(2), 303(2), 117(2) and 3(5) of the BNS, 2023, pending in the Court of the learned Judicial Magistrate, 1st Class, Deoghar. 4. Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in the case. She further submits that the altercation took place due to the dispute with regard to deep boring made ( 2026:JHHC:20864 ) -2- A.B.A. No. 2233 of 2026 With A.B.A. No. 3299 of 2026 by Nandan Kumar Choudhary, who is petitioner in A.B.A. No.3299 of 2026. She then submits that so far as the petitioners in A.B.A. No.2233 of 2026 are concerned, they are wife and daughter of Nandan Kumar Choudhary respectively. She next submits that by the last order, case diary was called for and now the case diary has been received and in the case diary, the allegation of assault by rod is not there. She also submits that the doctor has found that the said injury was due to fall on hard substance. She further submits that the petitioners in both the applications are having no criminal antecedent, as disclosed in paragraphs 10 and 9 of the application respectively. 5. Learned counsel appearing for the State and informant opposed the prayer and submit that the allegations of assault are there and the death of husband of the informant has also occurred. On these grounds, they submit that the prayer for anticipatory bail may kindly be rejected. 6. On perusal of the FIR, it transpires that the allegation of assault is there against Akash Choudhary and Nandan Kumar Choudhary and further, the death has occurred. Further in the postmortem report, it has come that the said injury was due to fall on the hard substance. In the attending facts and circumstances of the case, I am not inclined to extend the privilege of anticipatory bail to Nandan Kumar Choudhary, who is petitioner in A.B.A. No.3299 of 2026 and, as such, his prayer for anticipatory bail is, hereby, rejected. 7. So far as the petitioners in A.B.A. No.2233 of 2026 are concerned, they are wife and daughter of Nandan Kumar Choudhary and only allegation is made against them of snatching of silver chain and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory ( 2026:JHHC:20864 ) -3- A.B.A. No. 2233 of 2026 With A.B.A. No. 3299 of 2026 bail to the petitioners in A.B.A. No.2233 of 2026, namely, Rinku Devi @ Rinku Choudhary and Neha Kumari @ Simran Choudhary. 8. Accordingly, the petitioners in A.B.A. No.2233 of 2026, namely, Rinku Devi @ Rinku Choudhary and Neha Kumari @ Simran Choudhary are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Deoghar in connection with Rikhiya P.S. Case No.18/2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated: 14th July, 2026 Ajay/
