Virender Singh, Judge By way of present application, which has been filed under Order VII Rule 14 of CPC, a prayer has been made   to   permit   the   plaintiff­applicant   to   produce   the documents on record, as detailed in the head­note of the application. 2. The application has been moved on the ground that   in   the   present   suit,   non­applicant   had   moved   the application under Order VII Rule 11 of CPC, for rejection of the plaint, which was dismissed by this Court, vide order 1 Whether Reporters of local papers may be allowed to see the judgment? Yes. 2 dated 15.12.2023, and the said order was assailed before the Division Bench, by way of an appeal, FAO(OS) No. 23 of 2024. The Division Bench has allowed the appeal and rejected   the   plaint. Now,   as   per   the   learned   counsel appearing   for   the   applicant,   the   order   passed   by   the Division Bench, has been set aside and the order passed by this Court has been restored. 3. According to the applicant, the documents, as mentioned   in   the   head­note,   are   relevant   for   the   just adjudication   of   the   case   and   inadvertently,   those documents could not be filed at the initial stage of the lis. 4. Highlighting   the   fact   that   the   case   is   at   the initial   stage,   a   prayer   has   been   made   to   allow   the application. 5. When   put   to   notice,   application   has   been contested by the non­applicant/defendant, on the ground that the application is not maintainable and the applicant is estopped to file the present application on account of its own act and conduct. Averments of the application have also been denied. 6. Heard. 3 7. The   trial,   in   the   present   case,   has   not   yet commenced,   as   the   pleadings   are   yet   to   be   completed. Meaning   thereby,   the   case   is   at   the   initial   stage. The procedural laws are meant for advancement of justice and not to hamper the same. The plaintiff has approached this Court by way of present suit for recovery of the amount, as mentioned in the plaint. As such, the plaintiff has every right to produce the documents. 8. Moreover, the relevancy and authenticity of the documents   will   be   considered   at   the   appropriate   stage. Merely because the application has been filed at a later stage, does not mean, that the plaintiff is not entitled to produce those documents, which, according to the plaintiff, are relevant for just adjudication of the case. 9. Considering the above facts, application, under consideration, is allowed and documents are allowed to be taken on record. 10. Application stands disposed of, accordingly.
