Counsel for the Petitioner:
1. P GOVIND REDDY Counsel for the Respondent:
1. The Court made the following ORDER:
1. This Civil Revision Petition, filed under section 115 of the Code of Civil Procedure, 1908 (for short, ‘C.P.C’), is preferred by the petitioner/J.Dr, against the docket order dated 06.02.2012 passed by the learned Junior Civil Judge, Anaparthi, East Godavari District, (for short, ‘the Trial Court’), in E.A.No.257 of 2011 in E.P.No.56 of 2009 in O.S.No.46 of 2004. By the said order, the Trial Court directed the garnishee to deduct a sum of Rs.2,000/- per month from the salary of J.Dr towards satisfaction of the warrant amount. 2. A perusal of the proceeding sheets reveals that though the matter was listed under the caption for dismissal, there was no representation for the petitioner on 27.02.2026. Even today also, there is no representation for the petitioner. As per the endorsement in the cause list, the notice sent to the respondent has not been returned. Despite repeated opportunities to appear and advance the case, the petitioner remained absent.
It thus appears that the petitioner has lost interest in prosecuting the matter before this Court. 3. In view of the above, the Civil Revision Petition is dismissed as non-prosecution. There shall be no order as to costs. Miscellaneous applications pending, if any, shall stand closed. __________________________ JUSTICE BALAJI MEDAMALLI
