The prayer in this petition has been made for direction upon the respondent No.4 to consider the case and claim of the petitioner for payment of compensation of the land appertaining to Khata No.78, Plot No.57 (New Khata No.55, New Plot No.361/759) measuring an area of 9.54 decimals situated in Mauza-Kapasada, Dist-Dhanbad. 3. Learned counsel for the petitioner submits that the said land was purchased by the petitioner by registered deed no.7564 dated 25.06.2008. He submits that the land has been acquired however no compensation was paid to the petitioner and the petitioner has already moved before the District Land Acquisition Officer by Annexure-5. 4. The learned counsel for the respondent State and the respondent N.H.A.I jointly submit that the petitioner is having alternative remedy under the National Highways Act and the petitioner is having remedy to move before the competent authority in light of section 3H(4) of the said Act. 5. In view of above and considering that before the District 2026:JHHC:20434 Page | 2 Land Acquisition Officer the representation of the petitioner is pending, the petitioner is directed to file a fresh representation before the District Land Acquisition Officer, Dhanbad within two weeks. 6. If the said representation is filed by the petitioner within the said period, District Land Acquisition Officer, Dhanbad will pass a reasoned order on the said representation within a period of four weeks further thereafter. 7.
