JUSTICE ARUN KUMAR JHA ORAL ORDER 2 19-06-2026 The present petition has been filed for modification of the order dated 10.08.2022 passed by this Court in Criminal Misc. No. 22775 of 2022. While granting bail to the petitioner, it was one of the conditions that one of the bailors will be Md. Shahzada Hussain, nephew of the petitioner, who had sworn the affidavit in the bail petition. Another condition was that bail bond of the petitioner would be accepted only after framing of charge, if not already framed. 2. Learned counsel further submits that charges have been framed on 29.04.2026 but nephew of the petitioner, Md. Shahzada Hussain, left for Dubai in connection with his work in 2023 and since then he has been staying there. Therefore, Md. Shahzada Hussain is not in a position to become one of the Patna High Court CR. MISC. No.35203 of 2026(2) dt.19-06-2026 2/2 bailors in terms of condition put by this Court in its order dated 10.08.2022. 3. Having regard to the submission of the learned counsel for the petitioner, the condition that one of the bailors would be Md. Shahzada Hussain, nephew of the petitioner, deponent of the affidavit filed Criminal Misc. No. 22775 of 2022, is modified with new condition that ‘one of the bailors will be the deponent of the present petition, i.e., Md. Ragib’. At the same time, while furnishing the bail bond, the petitioner would produce the document related to non-availability of Md. Shahzada Hussain in the country before the learned trial court to show his bonafide. 4.
