The petitioner is apprehending his arrest in connection with Sindri PS Case No.23 of 2026, for offence registered under section 126(2), 115(2), 109, 118(1), 303(2) and 3(5) of BNS, 2023, pending in court of learned Judicial Magistrate, 1st Class, Dhanbad. 3. Learned counsel for petitioner submits that false allegations are made against four named accused persons including the petitioner and 4-5 other persons of assault. He next submits that there is no doubt that altercation took place due to drainage system in the locality. He next submits that injury is simple in nature. 4. Learned State counsel opposes prayer and submits that the allegations are there of assault. 5. Considering that altercation took place due to dispute 2026:JHHC:20701 2 of drainage system in the locality although the allegations are there against the petitioner of assault, however, it has come in the order of the learned Sessions Judge that injury is found to be simple, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Magistrate, 1st Class, Dhanbad, in connection with Sindri PS Case No.23 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
